Submit a Communication

Prior to submitting a Communication, we invite you to read the following information, which is key to the process.

For consideration

States Parties are those countries that the meet the following criteria (all criteria must be met):

  • Countries listed in Annex 1 of the Regional Agreement on Access to Information, Public Participation and Justice in Environmental Matters in Latin America and the Caribbean (Escazú Agreement);
  • Countries that have deposited their instrument of ratification, acceptance, approval or accession of the Escazú Agreement with the United Nations Secretary-General; and
  • Countries with respect to which 90 days have elapsed since the deposit of their instrument of ratification, acceptance, approval of accession. Please note that the Committee may not receive communications on a State Party’s compliance until one year after the entry into force of the Escazú Agreement for that State Party.

Form structure

The Platform Form for the reception and processing of communications is divided into the following sections:

1Essential information

Either to request support in complying with the Escazú Agreement in a specific aspect, or to report non-compliance with the Agreement, any person may submit a communication on this platform, including the following cases:

  • Members of the public:
    • Individual natural person
    • Natural person on behalf of someone else
    • Natural person on behalf of a minor
    • Legal person
    • Groups of people, Associations, Organizations, etc.
  • State Party Focal Points, either for:
    • Request support for your country or acknowledge non-compliance with the Agreement.
    • Request support for another country or report that it is in non-compliance with the Agreement.

Documents supporting the communication

Depending on the case, specific documents must be attached to support your communication:

1.1 Members of the public

  • Natural person - Individual
    • Official identification document (ID or Passport)
    • Document verifying your connection with State Party
  • Natural person - On behalf of someone
    • Official identity document of the represented person (ID or Passport)
    • Document verifying the connection with State Party
    • Mandate of representation showing consent
  • Natural person - On behalf of someone - Under age
    • Official identification document of the minor (ID or Passport)
    • Document demonstrating legal parentage or custody
    • Document verifying the connection with State Party
    • Mandate of representation showing consent
  • Legal person
    • Document that verifies existence of the legal person
    • Representation mandate that contains the express consent of the represented legal person
    • Document proving the connection of the legal person with the State Party concerned.
  • Others (association, organization or group)
    • Document evidencing the existence of the entity it represents *
    • Representation mandate that contains the express consent of the represented entity
    • Document demonstrating the connection of the entity with the State Party concerned.

1.2 State Party with respect to itself

  • Official identity document (ID or Passport)

1.2 State Party with respect to another State Party

  • Official identity document (ID or Passport)
  • Document certifying that it counts with the corresponding full powers issued by the Head of State, Head of Government or Minister of Foreign Affairs of your State Party

2 Facts and provisions of the Escazú Agreement

Communications should contain a brief description of the facts supporting the statements and provide sufficient information to enable the Committee to consider them.

For this purpose, prepare files that serve as documentary evidence to support your request, whether Documents (Word or PDF) or Images. The originator of the communication has a duty to disclose in good faith all relevant material facts and information regarding the risk, as well as any change in the circumstances giving rise to the risk.

3Information on internal steps taken and other procedures

All relevant information on the steps taken in the State Party concerned to resolve the case or justify its absence should be indicated. To this end, prepare files that serve as documentary evidence of:

  • Option 1. The steps already taken in the State Party concerned to resolve the case.
  • Option 2. The absence of such proceedings. In addition, information should be provided on whether the same matter is being or was examined in the framework of another regional or international binding procedure (e.g. international court, regional/subregional court, or other binding procedures). For this purpose, attach the document(s) issued during such proceedings.

If you have additional corroborating documents or images of your submission, you may attach them in this section. Otherwise, leave blank.

* Key information

For security reasons, the form does not retain session data for later retrieval; therefore, all fields must be completed in a single session. It is crucial not to refresh the page during the process, as this will result in the loss of all information entered, requiring you to start over from scratch.
